the MARKET Price is a Trade Promotion Lottery.
Victoria: A permit is not required for promotions of $5000 or less. vcgr.vic.gov.au
NSW: A permit is required for promotions < $10000 or less.
the MARKET Price terms & conditions:
/ Entry is conditional upon agreement to the below terms and conditions.
1/ A member can enter 1 price per competition.
2/ The same price can be entered by multiple members. ie Member 1: $450000 Member 2: $450000
3/ However there must be at least $100 difference between unique price entries ie Member 3: $449900 Member 4: $450100
4/ The competition closes on the Date of Sale. Any entry posted on the "Date of Sale or after" will be deleted from the competition.
/ If the property is passed in at auction, you will receive a Property passed in e-mail and the competition will continue.
/ If the property is withdrawn from sale, you will receive a Withdrawn from sale e-mail and the competition will close without a winner.
5/ There can only be 3 winners per competition. 1st , 2nd , 3rd
6/ If multiple entries become eligible for the same prize IE 1st, the member who entered first (by date and time) would be declared the winner and the other entry/s would move down a Prize position according to the date and time of entry and Price $ entered.
7/ If you are eligible for a prize:
You are agree to not change your membership "My Profile" details in your admin until all of your prize/s have been received.
Failure to follow this term may result in your information being lost or deleted without any record available to substantiate any claim.
8/ You must be 18 years of age or older to enter.
9/ You must reside in the same State as the property for sale.
10/ Registered members will receive information via e-mail from location.com.au.
11/ location.com.au will make all efforts to successfully host a the MARKET Price competition.
In the event of any unforeseen circumstance location.com.au reserves the right to delete any entry/member or cancel a competition for any reason.
12/ Complaints: Please contact the Promotor (the agent) no later than 14 days after the Settlement Date, or the complaint will not be heard.
PRIVACY
1. Only the entrants First Name, Membership #, Price $ entered, Date and Time of entry will display on the "Market Price" page.
2. Only the top 3 winning entries Full Names and Membership #'s will display in the Winners section.
3. Only the top 3 winning entries Full names, Membership #'s, Address details (for cash prizes) and E-mail addresses, will be seen by The Promoter (the agent).
4. If an individual cash prize exceeds $250, the Promoter (the agent) must post the winners name in a newspaper.
The PROMOTOR (The Agent) >
/ The Promoter (the agent) is responsible for the amount of each prize and for the payment/delivery of all cash prizes.
/ If the individual value of a prize in the competition exceeds $250 the name of the winner must be published in a newspaper circulating generally in Victoria. However, if the total value of the prizes for the lottery is $500 but an individual prize exceeds $250, the name of the winner only needs to be published in a newspaper circulating generally in the area which the trade promotion lottery was held.
/ Date of Sale: The Promoter (the agent) is responsible for posting the "Date of Sale, Final Sale Price $ and Settlement Date" within 3 days after the Date of Sale.
An automatic e-mail will be sent to all entrants announcing the results of the competition.
/ Settlement Date: The Promoter (the agent) is responsible for the payment/delivery of all prizes within 7 days after the Settlement Date.
The Promotor (the agent) must not delete the property page until after the Settlement Date and all prizes have been sent.
Note: All prizes must be sent to the winners, even if the settlement is not completed.
/ The top 3 winners contact information (for cash prizes) will display in The Promoter (the agent) password protected Admin area immediately after the agent enters the Date of Sale, Final Sale Price $, Settlement Date and clicks Show Winners.
/ The Promoter (the agent) reserves the right to change the property page details at any time, except for the following information:
URL, Prizes, Street # Name Suburb.
Note: This does not apply if the property is withdrawn from sale and the competition will close.
/ The Promotor (the agent) must respond to any complaint if made no later than 14 days after the Settlement Date.
